Improper Omission as an Amplifier Device of the Criminal Statue in Colombia.Armando Noriega Ruiz, José Luis Robles Tolosa, Elina Marcela Meriño Ortega & Andrés Felipe Soto Barrios - forthcoming - Evolutionary Studies in Imaginative Culture:1901-1923.
In the evolution of criminally relevant action in modern crime theory, social action has assumed a particular significance as a dogmatic element that enables the effective protection of legal assets in a society beset by risks. In the vast array of theories regarding the role of the guarantor and its legal and doctrinal development, as well as the jurisprudential extension of equivalence clauses of improper omissions that serve as amplifier devices of the criminal statue through an indirect adaptation, there is (...)

    The SARS‐CoV‐2 origin dilemma: Zoonotic transfer or laboratory leak?Blanca E. Ruiz-Medina, Armando Varela-Ramirez, Robert A. Kirken & Elisa Robles-Escajeda - 2022 - Bioessays 44 (1):2100189.
The COVID‐19 pandemic is responsible for millions of deaths worldwide yet its origin remains unclear. Two potential scenarios of how infection of humans initially occurred include zoonotic transfer from wild animals and a leak of the pathogen from a research laboratory. The Wuhan wet markets where wild animals are sold represent a strong scenario for zoonotic transfer. However, isolation of SARS‐CoV‐2 or its immediate predecessor from wild animals in their natural environment has yet to be documented. Due to incomplete evidence (...)

  5. Structural Trauma.Elena Ruíz - 2024 - Meridians: Feminism, Race, Transnationalism 23 (1):29-50.
This paper addresses the phenomenological experience of precarity and vulnerability in racialized gender-based violence from a structural perspective. Informed by Indigenous social theory and anti-colonial approaches to intergenerational trauma that link settler colonial violence to the modalities of stress-inducing social, institutional, and cultural violences in marginalized women’s lives, I argue that philosophical failures to understand trauma as a functional, organizational tool of settler colonial violence amplify the impact of traumatic experience on specific populations. It is trauma by design. I explore (...)

  7. Postcolonial and Decolonial Feminisms.Elena Ruíz - 2021 - In Ásta . & Kim Q. Hall (eds.), The Oxford Handbook of Feminist Philosophy.
In recent years postcolonial and decolonial feminisms have become increasingly salient in philosophy, yet they are often deployed as conceptual stand-ins for generalized feminist critiques of eurocentrism (without reference to the material contexts anti-colonial feminisms emanate from), or as a platform to re-center internal debates between dominant European theories/ists under the guise of being conceptually ‘decolonized’. By contrast, this article focuses on the specific contexts, issues and lifeworld concerns that ground anti-colonial feminisms and provides a brief survey of the literature. (...)

This chapter proceeds in two ways. First, I argue that Fanon’s structural witnessing of racism yields important insights about the nature of violence that challenges the settler colonial concept of violence as the extra-legal use of force. Second, I argue that his analysis of violence is insufficient for combating colonial racism and violence because, using the terms of his own analysis, it leaves intact logics and mechanisms that allow racism to structurally renew itself in perpetuity: violence against women. Without a (...)

Provocative Insinuations as Hate Speech: Argumentative Functions of Mentioning Ethnicity in Headlines.Álvaro Domínguez-Armas, Andrés Soria-Ruiz & Marcin Lewiński - 2023 - Topoi 42 (2):419-431.
We explore a particular type of propagandistic message, which we call “provocative insinuation”. For example: ‘Iraqi refugee is convicted in Germany of raping and murdering teenage girl’. Although this sentence seems to merely report a fact, it also conveys a potentially hateful message about Iraqi refugees. We look at the argumentative roles that these utterances play in public discourse. Specifically, we argue that they implicitly address the question of the integration of refugees and migrants, and in fact aim to tilt (...)

In the first part of the paper the authors analyze how the distinction between mandatory rules, principles in the strict sense and policies can be understood in structural terms and in terms of reason for action. In the second part, they attempt to clarify which kind of legal provisions embrace constitutional statements recognizing liberty rights are.

In the wake of continued structural asymmetries between women of color and white feminisms, this essay revisits intersectional tensions in Catharine MacKinnon’s Toward a Feminist Theory of the State while exploring productive spaces of coalition. To explore such spaces, we reframe Toward a Feminist Theory of the State in terms of its epistemological project and highlight possible synchronicities with liberational features in women-of-color feminisms. This is done, in part, through an analysis of the philosophical role “method” plays in MacKinnon’s argument, (...)

    Cancer development and progression: A non-adaptive process driven by genetic drift.Armando Aranda-Anzaldo - 2001 - Acta Biotheoretica 49 (2):89-108.
The current mainstream in cancer research favours the idea that malignant tumour initiation is the result of a genetic mutation. Tumour development and progression is then explained as a sort of micro-evolutionary process, whereby an initial genetic alteration leads to abnormal proliferation of a single cell that leads to a population of clonally derived cells. It is widely claimed that tumour progression is driven by natural selection, based on the assumption that the initial tumour cells acquire some properties that endow (...)

Studies investigating the COVID-19 pandemic from a psychological point of view have mostly focused on psychological distress. This study adopts the framework of existential positive psychology, a second wave of positive psychology that emphasizes the importance of effective coping with the negative aspects of living in order to achieve greater wellbeing. Trait emotional intelligence (trait EI) can be crucial in this context as it refers to emotion-related personality dispositions concerning the understanding and regulation of one’s emotions and those of others. Intra-organizational social capital in business organizations. A theoretical model with a focus on servant leadership as antecedent.Pablo Ruíz, Ricardo Martínez & Job Rodrigo - 2010 - Ramon Llull Journal of Applied Ethics 1 (1):43-59.
This paper explores the antecedents of intra-organizational social capital from a comprehensive perspective that integrates leadership as the main antecedent. To be precise, we propose that intra-organizational social capital is a direct consequence of an organizational ethical and community context to which leadership in the servant dimension plays a transcendental role. Indeed, since the seminal work of Greenleaf the servant leadership concept has been widespread among business academics and professionals for the value it brings to the organization not only in (...)

In this paper the author states that education could be better defined as reception and responsibility and that this ethical relationship between educator and pupil is the root or essential element of education. The author proposes a new paradigm, the pedagogy of alterity, inspired by Le´vinas, as a different model for educational praxis and research. Education as reception and responsibility facilitates the learning of values and a moral environment in the classroom and it is a fundamental support for the pupils (...)

Juan Ruiz Manero - 2015 - Revus 26.
The paper critically examines Bobbio's famous disctinction between legal positivism as a method, a theory and an ideology. The author first highlights certain problems of the distinction itself and then focuses on Bobbio's self-determined position within it. Delving on Bobbio's analysis of the concepts of basic norm and rule of recognition, he demonstrates how Bobbio's later rejection of these two concepts implies acceptance of positivistic legal theory and ideology – despite the fact that he explicitly rejected them in the first (...)

Understanding Death in Custody: A Case for a Comprehensive Definition.Géraldine Ruiz, Tenzin Wangmo, Patrick Mutzenberg, Jessica Sinclair & Bernice Simone Elger - 2014 - Journal of Bioethical Inquiry 11 (3):387-398.
Prisoners sometimes die in prison, either due to natural illness, violence, suicide, or a result of imprisonment. The purpose of this study is to understand deaths in custody using qualitative methodology and to argue for a comprehensive definition of death in custody that acknowledges deaths related to the prison environment. Interviews were conducted with 33 experts, who primarily work as lawyers or forensic doctors with national and/or international organisations. Responses were coded and analysed qualitatively. Defining deaths in custody according to (...)

The aim of this paper is to render a detailed analysis of the correspondence with Clarke in order to shed some light in the relationship between the Principle of Identity of Indiscernibles and the Principle of Sufficient Reason. Most of the secondary literature takes for granted that Leibniz derives the Principle of Identity of Indiscernible from the Principle of Sufficient Reason in at least some parts of the correspondence. This would render the Principle of Identity of Indiscernibles a merely contingent (...)

The article begins by considering Wittgenstein’s notion of family-resemblance concepts. The article purports to defend that there is something wrong with the idea that language is a family-resemblance concept, that is, that we take behaviour as being linguistic merely in virtue of undetermined similarities with paradigmatic linguistic behaviour. In order to achieve this goal, it is first clarified in which sense so-called psychological concepts are not family-resemblance concepts. The essential link between the use of the expressions “language” and “linguistic behaviour” (...)
